WHEN TO ENTER: Romano's Macaroni Grill "Create Your Own Pasta Contest" ("Contest") starts on 2/19/07 at 12:00 A.M., ET and ends on 4/29/07 at 11:59:59 P.M., ET ("Contest Period"). All entries must be received by 4/29/07 at 11:59:59 P.M., ET.
HOW TO ENTER: Go to www.createyourownpasta.com during the Contest Period and complete the Registration Form. On the web page, "Select Your Favorite Ingredients and Impress Our Chefs," click the boxes of the ingredients you would use to "create your own pasta" recipe. Additionally, you can also enter a "secret ingredient" in the indicated box. After you have completed your ingredient selection, click "continue" to see whether or not you have impressed the Romano's Macaroni Grill Virtual Chef ("RMG Virtual Chef") according to its pre-programmed ingredient combination choices. If your first recipe has not impressed the RMG Virtual Chef, you may continue to create additional recipes until you have created a recipe that does impress the RMG Virtual Chef. Once you have created a recipe that does impress the RMG Virtual Chef, submit the required information including the name you have created for your recipe. Limit: You may enter one recipe per day that has impressed the RMG Virtual Chef.
HOW THE CONTEST WORKS: (A) Random Drawing: On or about 4/30/07, the names of 500 "Create Your Own Pasta" recipe entrants will be selected in a random drawing from among all eligible entries that were entered by an independent judging agency whose decisions will be final in all matters pertaining to this Contest. (B) Selection of Winning Create Your Own Pasta Recipe: Beginning on or about 5/1/07, a panel of judges consisting of Romano's Macaroni Grill chefs will read the 500 recipes selected in the random drawing and will evaluate each recipe based on their personal knowledge, perception and experience (the judges will not actually prepare any of the recipes). The judges will rate each recipe based on the following criteria: (1) Appropriate Taste/Flavor: 50%; (2) Innovative ingredient selection: 40%; (3) Creativity of name: 10%. NOTE: Any recipe that includes a name that is deemed, in the sole discretion of the judges, to be offensive, lewd, or otherwise in bad taste will be disqualified. The recipe with the highest score shall be declared the winning "Create Your Own Pasta Recipe Winner." In the event that two or more recipes are awarded the same score, a random drawing will be held to determine the winning "Create Your Own Pasta Recipe." The decisions of the judges will be final. The potential Winner of the Contest will be notified by phone, email and/or mail on or about 5/31/07. Odds of winning depend on the number of eligible entries submitted and the decision of the judges.
MAC PACK: Whether or not your recipe impressed the Virtual Chef after you have "created your own pasta recipe," you can follow the instructions to become a member of the Mac Pack and receive one (1) free appetizer at your favorite Romano's Macaroni Grill Restaurant. Free appetizer requires the purchase of two adult entrees at the time of visit.
TELL-A-FRIEND: You may forward to a total of (5) friends about the Contest throughout the Contest Period and with whom you have an existing personal relationship and who you think would be interested in receiving the email.
PRIZE: Prize (1): One (1) Winner will receive a Five Hundred Dollar ($500) Romano's Macaroni Grill Gift Card ("Card") to be used towards purchases at his/her favorite participating Romano's Macaroni Grill, and Winner's recipe shall be included on the Romano's Macaroni Grill Menu at a future date for an unspecified amount of time. Card must be used in compliance with its terms and conditions and as allowed by law. Card is not redeemable for cash; nor is it transferable or substitutable, except by Sponsor with a prize of equal or greater value. Any federal, state or local taxes are the sole responsibility of the Winner.
ELIGIBILITY: Contest is open only to legal residents of the 50 United States and District of Columbia, 18 years of age or older at the time of entry, except employees and members of their household and of their immediate family (i.e. parents, children, siblings, spouse and members of such immediate family member's household) of Sponsor, its affiliates, divisions, subsidiaries; its advertising/ promotion agencies, judging organization; or any third party associated with the development, administration or supply to this Contest (collectively, "Sponsor, et al."). Potential Winner will be required to sign and return Affidavits of Eligibility/Compliance & Publicity/Liability Release, where permitted by law. Failure to sign and return these and other such requested documents by the return date specified in the Prize notification letter will result in forfeiture of the Prize and selection of an alternate Potential Winner.
RIGHT TO USE RECIPE: Each entrant represents that s/he has the right to submit her/his recipe into the Contest and such submission is not restricted in any manner. By submitting her/his recipe, entrant unconditionally assigns and transfers to Sponsor all rights, title, interest and claim in the recipe, including, without limitation, all intellectual property rights therein. Sponsor shall have the right to use the recipe (along with the entrant's first name, initial of last name, and city/state of residence) in its business or otherwise, including the right to list the recipe on its website and to list the winning recipe on its menu, as well as the right to publish, alter, assign, edit, sell, license or dispose of such recipe, however Sponsor sees fit, worldwide, in perpetuity in all forms of media now known or hereinafter devised, without approval of, or compensation to, entrant.
INTERNET: Sponsor, et al. are not responsible for interrupted or unavailable network server, browser, or other connections, miscommunications, failed telephone or computer transmissions or jumbled, scrambled or misdirected entries or transmissions, or for phone, electrical, network, computer hardware or software or program malfunctions, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person's computer related to participating in the promotion. Sponsor, et al. are not responsible for illegible, unintelligible, late, lost or stolen entries or incorrect or inaccurate entry information, whether caused by Internet users or by any of the equipment or programming associated with or utilized in the promotion or by any technical or human errors which may occur in the processing of any entries in this promotion. Persons found tampering with or abusing any aspect of this promotion, as solely determined by Sponsor, will be disqualified and may be subject to prosecution. Any entrant, who attempts to play with multiple e-mail addresses, under multiple identities or uses any device or artifice to play multiple times, will be disqualified from participation in the Sweepstakes. If in the judgment of Sponsor, the Contest is compromised by virus, bugs, non-authorized human intervention or other causes beyond the control of Sponsor, which corrupts the administration, security, fairness or proper play of the Contest, Sponsor reserves the right, in its sole discretion to discontinue, suspend or terminate the Contest. In the event of any such discontinuation, suspension or termination, the recipes to be selected as described in Rule 3(A) will be determined from among all eligible entries received to date, in a random drawing to be conducted by the judges following the discontinuation, suspension or termination. Any personally identifiable information collected during an entrant's participation in this promotion will be collected by Sponsor and used by Sponsor, its affiliates, agents and marketers for purposes of the proper administration and fulfillment of the Sweepstakes as described in these Official Rules and in accordance with Sponsor's Privacy Policy as stated at http://www.createyourownpasta.com/privacy. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON (S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Entry of a recipe into this Contest shall constitute and signify the entrant's agreement and consent that Sponsor may use the entrant's first name, initial of last name, address (city, state), for promotional purposes worldwide, including on the Internet, without limitation and without further payment or consideration, except where prohibited by law. Sponsor, et al. are not responsible for any liability whether directly or indirectly, including, without limitation, liability in connection with any injuries, damages or losses of any kind, whether direct or indirect, whether to property or person, including death, arising out of the acceptance, enjoyment, use and/or misuse of the Prize and/or participation in this Contest, and they will be held harmless against any claims of liability arising directly or indirectly from the Prize awarded or participation in this Contest. Sponsor shall not be responsible for illegible, damaged, lost, late, stolen, postage due, incomplete, undelivered/undeliverable, misdirected or returned entries and/or mail.
